These terms of service (the “Agreement”) govern your use of BudgetSimple, a service of Internet Financial Company, LLC (“BudgetSimple” or the “Company” or “we”), and any websites, features, products, graphics, text, images, photos, audio, video, computer code, and all other forms of data and communications (collectively, “Content”) made available by the Company (together, “Services”).
By accessing or using the Services, you confirm your agreement to be bound by this Agreement. If you do not agree to this Agreement, you may not access or use the Services. This Agreement expressly supersedes prior agreements or arrangements with you regarding the use of the Services.
The Company may update this Agreement from time to time. If changes are made, we will notify you by email if an email address has been provided and require your agreement to the updated terms when logging back into the Services. Continued use of the Services constitutes acceptance of the new terms.
I. Description of the Services
BudgetSimple is a white-label B2B personal finance platform for businesses and organizations. It includes tools for budgeting, debt tracking, financial calculators, and a learning management system (LMS) for educational content. Businesses can choose to charge their users a subscription fee or provide their platform instance for free.
BudgetSimple offers several subscription plans—Creator, Pro, and Organizations—which may include additional service fees paid to Internet Financial Company, LLC (dba BudgetSimple).
II. Subscription Plans and Payments
A. Subscription Options
BudgetSimple offers the following subscription plans:
- Creator Plan:
- $79/month or $948 annually (save $240/year)
- Pro Plan:
- $159/month or $1908 annually (save $480/year)
- Organizations Plan:
- $319/month or $3828 annually (save $960/year)
B. Payment Terms
Subscriptions are billed monthly or annually based on the user’s selection. Businesses pay these fees to access BudgetSimple’s platform and services.
C. Refund Policy
BudgetSimple offers a 30-day money-back guarantee for all plans. Refunds are not provided beyond the initial 30 days from the signup date.
D. Cancellation Policy
Users can cancel their subscription at any time through their account settings. Upon cancellation, users will retain access to the Services until the end of the current billing cycle. However, canceled accounts are not eligible for refunds unless within the 30-day guarantee period.
III. User Responsibilities
A. Eligibility
The Services are available globally to users aged 18 years and older.
B. Account Security
Users may create multiple accounts and are solely responsible for maintaining the confidentiality and security of their account credentials.
C. Prohibited Activities
Users agree not to:
- Exploit or harm other users.
- Engage in fraudulent activity.
- Misuse the platform to upload or distribute harmful or illegal content.
IV. Content and Intellectual Property
A. Proprietary Content
All tools, templates, and resources provided by BudgetSimple are proprietary to the Company.
B. User Access to Content
Users may utilize content from the platform’s content library for email campaigns or within the platform itself. However, such content may not be published on external websites.
C. Content Use Post-Cancellation
If a user cancels their subscription, they must delete all previously downloaded or stored content from the content library.
D. Branding Restrictions
Users may not use BudgetSimple branding, including logos or trademarks, without prior written permission.
V. Disclaimers and Limitations of Liability
A. No Financial Advice
BudgetSimple does not provide financial advice. All content, tools, and resources are for informational and entertainment purposes only. Users are solely responsible for any financial decisions made using the platform.
B. Data Accuracy
BudgetSimple cannot guarantee the accuracy of financial data imported into the platform or calculations generated by its tools.
C. Limitation of Liability
To the fullest extent permitted by law, BudgetSimple is not liable for any damages, including direct, indirect, incidental, or consequential damages arising from the use of the Services.
VI. Arbitration and Dispute Resolution
Any disputes arising out of or relating to this Agreement or the Services will be resolved through binding arbitration administered by the American Arbitration Association. Users waive the right to participate in class actions, class arbitrations, or other representative actions.
VII. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of Delaware. The venue for any disputes, including arbitration or litigation, will be Wilmington, Delaware.
VIII. Termination
The Company reserves the right to suspend or terminate a user’s access to the Services for violations of this Agreement or any harmful activity. Terminated users are not entitled to a refund except as specified in the refund policy.
IX. General Provisions
A. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
B. Entire Agreement
This Agreement, along with the Privacy Policy, constitutes the entire agreement between the Company and the user, superseding any prior agreements.
